1. Background
I, (name of the "Releaser"), HEREBY EXECUTE this Waiver and Release, to release Matthew John Fish on behalf of the Jindabyne Rugby Union
Football Club (the "Releasee"), of 269 Geikle Creek Road, Jindabyne, New South Wales.
2. Methods of Payment
Payment can be made either directly to the Jindabyne Rugby Union Football Club (JRUFC) via EFT or cash on collection
of vehicle to Matthew John Fish for the amount detailed on the invoice.
3. Sum Insured
All Buses are covered with NRMA commercial roadside assistance (Membership details are on bus keys) and full comprehensive insurance. JRUFC Insurance Policy incurs an excess of $2,000.00. In the event of an accident, the releaser will incur either the excess amount or the cost of repair, whichever is less.
4. Return of Vehicle.
Vehicle/s hired must be retuned full of fuel and in a clean state as they were on collection. Failure to do so will result in the releaser incurring not only the cost to fill up the bus but time taken to refuel and clean the bus. Buses may only carry the amount of people stipulated upon hire.
12-seater buses 1 driver 11 passengers.
14-seater buses 1 driver 13 passengers.
20-seater buses 1 driver 19 passengers.
5. Nature of Activity
I, the Releaser, wish to hire the following vehicle’s, and acknowledge that I and/or all drivers are licensed correctly to do so.
6. Waivers
I, the Releaser, hereby Waive, Release, and Discharge the Releasee (who runs or operates this activity) and his or her heirs, legal representatives, administrators, and executors for all liability for or by reason of any damage, loss or injury (including death) to myself or my property which has been or may be sustained as a result of my participation in the activity, and notwithstanding that such damage, loss or injury may have been caused solely or partly by the Releasee’s negligence.
7. Acknowledgement
I, the Releaser, hereby acknowledge the following:
1. I have read this Release thoroughly and I fully understand it.
2. I am voluntarily executing this Release and would not otherwise be permitted to participate in this activity.
3. This Release restricts me from suing or otherwise claiming against the Releasee, presently or at any future time, for damage, loss, or injury that may occur to myself or my property because of participating in this activity.
4. I have been granted the opportunity to seek independent legal advice before executing this Release.
8. Binding Effects
This Release shall be binding on and inure to the benefit of the spouses, heirs, executors, successors, legal representatives, administrators, and assigns of the Releaser and Releasee.
9. Medical Conditions
To the best of my knowledge, I, the Releaser and all the drivers, are in good health and do not have any illnesses, ailments, physical or mental disabilities that would limit or prevent my/their participation in this activity. I will provide a medical examination and clearance if required.
10. Final Agreement
This Waiver and Release contains the entire agreement between the two parties and there are no further provisions, either written or oral. The terms of this Waiver and Release are contractual and not a mere recital.
11. Governing Law
This Waiver and Release is being delivered in and shall be governed, construed, enforced, and interpreted by, through and under, the laws of the State of New South Wales, excluding conflict of law principles that would cause the application of
laws of another jurisdiction.
